business 1. LEGAL INFORMATION AND PUBLISHER

The Atlas Ways mobile application (available on iOS and Android) and the associated website visit.atlasways.app (collectively, the "Service") are privately developed, published, and managed.

Hosting and Infrastructure:
The backend, Cloud Firestore database, file storage (Firebase Storage), and public website are hosted by Google LLC through the Firebase platform (1600 Amphitheatre Parkway, Mountain View, CA 94043, United States). Mapping and location search services are provided by Mapbox, Inc. (740 15th St NW, Washington, DC 20005, United States). Transactional notifications are routed through Resend, Inc.

By downloading, installing, or using the Service, you acknowledge that you have read and unconditionally accepted these Terms. If you do not agree to these terms, you must stop using the Service.

description 2. SERVICE DESCRIPTION

Atlas Ways is a trip planning and management application, primarily designed for road trips, hikes, and expeditions. The Service includes the following features:

  • Adventure creation and management: organizing multi-stage itineraries with geolocated departure points, destinations, and waypoints.
  • Trip phases: the application distinguishes between the "Architect" phase (pre-departure planning) and the "Co-pilot" phase (active mode during the adventure).
  • Budget management: expense tracking, categorization, variable daily budget calculation, and fuel cost estimation based on the configured vehicle.
  • Vehicle management: configuring vehicle technical specifications (fuel consumption, dimensions, fuel type) for trip estimates.
  • Activity suggestions (AI): automated generation of personalized activity suggestions based on your itinerary context via third-party artificial intelligence services. By using this feature, you acknowledge that AI-generated content is provided for inspiration only and may contain errors or inaccuracies.
  • Logbook: daily travel journal for structured text entries, adding photos, logging activity check-ins, and recording a daily mood.
  • Trip document management: importing and organizing booking confirmations, tickets, and insurance certificates in PDF, image, or text format.
  • Preparation checklists: customizable checklists organized by categories and timeframes for methodical pre-departure preparation.
  • Accommodation management: planning and tracking lodging at each stage.
  • Team collaboration: inviting co-travelers ("Editor" role) to plan and document the trip together.
  • Public sharing ("Follower" Viewer): generating a secure, anonymized sharing link allowing third parties to follow the adventure in read-only mode via visit.atlasways.app.

Atlas Ways is not a real-time GPS navigation system, turn-by-turn guidance software, or a safety tool. It does not replace dedicated navigation solutions or official road signage.

analytics 3. ACCESS CONDITIONS AND AVAILABILITY

Use of the Service is restricted to natural persons of legal age (or minors with express parental consent) who hold a valid user account created through Firebase Authentication. Access is conditional on acceptance of these Terms upon first use.

The Publisher endeavors to keep the Service accessible 7 days a week, 24 hours a day. However, as this is a non-commercial project, no contractual availability guarantee is provided. Access may be suspended at any time for:
• Planned or corrective maintenance of the Firebase infrastructure;
• Deployment of application updates;
• Unforeseen technical incidents at hosting providers.

These interruptions do not give rise to any compensation. The Publisher cannot be held liable for Service unavailability due to force majeure or failures of third-party services (Firebase, Mapbox, mobile network, etc.).

A partial offline mode is integrated into the application: planning data previously synchronized remains accessible for viewing without an Internet connection, within the technical limits of local caching.

person 4. USER OBLIGATIONS AND RESPONSIBILITIES

Users agree to use the Service in strict compliance with applicable laws, and in a personal, non-commercial capacity. Users are expressly prohibited from:

  • Compromising the security or integrity of the Service, including through hacking, reverse engineering, code injection, or vulnerability exploitation;
  • Generating automated requests or using bots to overload the infrastructure;
  • Sharing unlawful, defamatory, hateful, or third-party rights-infringing content through the logbook or public sharing features;
  • Impersonating another user or providing false identification information;
  • Using collaboration features to harass, threaten, or harm other users;
  • Using the Service for commercial purposes without prior written authorization from the Publisher.

Users are solely responsible for the content they publish in their logbook, including photos, texts, and information shared via a public link. They guarantee that they hold all necessary rights over the content they upload (photos, documents).

lock 5. LIMITATION OF LIABILITY

The Service is provided "as is" and "as available," without warranty of any kind, express or implied.

The Publisher cannot be held liable for:

  • Accidents, incidents, and road safety: itineraries and trip estimates generated by the application are provided for informational purposes only. They do not constitute driving advice. Users assume full responsibility for their travel and must always comply with traffic laws, official road signs, and actual road conditions.
  • Road accessibility: the application does not guarantee that planned routes are accessible, open, passable by the configured vehicle, or free from traffic restrictions, tolls, private roads, or unlisted hazards.
  • Mapping accuracy: map data is provided by Mapbox and may contain inaccuracies, update delays, or errors. The Publisher does not control the quality of Mapbox data.
  • Artificial Intelligence Suggestions: The Service provides trip and activity suggestions generated by artificial intelligence technologies (third-party providers). These suggestions are automated and for informational purposes only. The Publisher does not guarantee their accuracy, safety, actual accessibility, or relevance. The Publisher disclaims all liability for consequences resulting from reliance on AI-generated suggestions. Users must exercise judgment and independently verify the feasibility and safety of each suggestion.
  • Data loss or corruption: the Publisher does not guarantee the permanent integrity of stored data. Accidental deletion of content (itineraries, journals, photos) does not engage the Publisher's liability.
  • User-generated content: the Publisher cannot be held liable for content published by users in their logbooks or shared publicly.
  • Third-party service interruptions: any unavailability related to Firebase, Mapbox, or Resend services is beyond the Publisher's control.

In all cases, the Publisher's liability shall not exceed the amounts, if any, paid by the user for access to the Service.

share 6. PUBLIC SHARING AND THIRD-PARTY DATA PROTECTION

Atlas Ways allows users to generate a secure public sharing link so that third parties ("Followers") can view their logbook via visit.atlasways.app.

Security mechanism: the public link is based on a random and unique sharing code. This code does not reveal the actual trip identifier or any user identification information. Data transmitted to Followers is sanitized server-side by a secure Cloud Function.

Scope of sharing: users control what they share. They can choose to share only the logbook or also the itinerary. Visibility can be enabled or disabled at any time from the trip settings.

Responsibility for shared content: the user who generates a public sharing link is solely responsible for the content made accessible. They must ensure that published photos, texts, and information do not infringe upon the privacy or rights of third parties (including photographed individuals).

Follower comments: people with access to the public link may, if the feature is enabled, leave comments on logbook entries. The adventure owner is responsible for moderating this content.

group 7. COLLABORATION AND TEAM MANAGEMENT

Atlas Ways includes an invitation system allowing the trip owner ("Owner" role) to invite other Service users ("Editor" role) to collaborate.

Roles and permissions:
• Owner: full control over the trip, can invite and revoke members, configure sharing settings, and delete the adventure.
• Editor: can contribute to planning, the logbook, and expenses, within the limits defined by the Owner.

Invitations: invitations are sent via the guest's email address. Accepting an invitation constitutes acceptance of sharing certain profile data (name, profile photo) with other adventure members.

Revocation: the Owner can revoke a member's access at any time. Revocation removes the member's access to the trip data, without deleting previously recorded contributions.

The Service Publisher cannot be held liable for disputes arising between members of a travel team regarding the collaborative management of content.

location_on 8. USE OF GEOLOCATION

Atlas Ways occasionally requires access to your device's location. This access is strictly controlled:

Authorized uses:
• Displaying your position on the planning map (blue dot) to help you locate yourself relative to your itinerary.
• Suggesting nearby points of interest or locations when creating stages (Mapbox search).

Privacy guarantees:
• Your GPS position is never transmitted to the Publisher's servers or to third parties.
• No history of your movements, speed, or trajectory is collected, recorded, or analyzed.
• Location access occurs only when triggered by user actions (e.g., "Locate me"). There is no background tracking.

Permission management: you can revoke location access permission at any time from your operating system settings (iOS or Android). This revocation does not affect other application features.

lock 9. PERSONAL DATA AND PRIVACY

Atlas Ways is built on the principle of "Privacy by Design": only data strictly necessary for the Service's operation is collected.

Data collected:
• Identity: full name and email address (entered during account creation).
• Profile photo: optional, uploaded to Firebase Storage.
• Trip data: itineraries, stages, notes, budget, expense categories, checklist structure, vehicle and accommodation information.
• Logbook: texts, photos, and metadata from daily entries, stored on Firebase Storage (photos) and Cloud Firestore (metadata).
• Trip documents: PDF files and images imported into the application, stored encrypted on Firebase Storage.
• Collaboration data: team member identifiers and data necessary for invitations.
• Anonymized usage data: Firebase Analytics collects aggregated and anonymous usage data (crashes, navigation flows) to improve the application. This data cannot personally identify a user.
• Artificial Intelligence Processing: To provide the activity suggestion service, non-personally identifiable contextual data (such as the requested interest type and approximate geographic coordinates) are securely transmitted to third-party artificial intelligence providers. No personal identification data (name, email address, profile photo) is shared with these third parties.

Data is stored securely on Google LLC's Firebase servers (Cloud Firestore and Firebase Storage) in the United States, with encryption in transit (TLS) and at rest (AES-256).

The Publisher formally commits to never selling, renting, transferring, or commercially exploiting your personal data to third parties for advertising or other purposes.

analytics 10. YOUR RIGHTS (GDPR / PIPEDA)

In accordance with the General Data Protection Regulation (GDPR) and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), you have the following rights:

  • Right of access: obtain a copy of the personal data we hold about you.
  • Right of rectification: correct your information directly from the application settings (profile, name, email).
  • Right to erasure ("right to be forgotten"): request the complete and irreversible deletion of your account and all associated data (trips, photos, documents, comments). Deletion can be performed directly in the application (Profile > Delete my account) or by sending a request to support@atlasways.app. Deletion is permanent and effective within 30 days.
  • Right to data portability: request your data in a structured, readable format.
  • Right to object: object to the processing of your data for certain purposes.
  • Right to withdraw consent: withdraw your consent at any time, without affecting the lawfulness of prior processing.

business 11. INTELLECTUAL PROPERTY

All elements constituting the Atlas Ways application — including the source code, architecture, design, graphics, icons, animations, texts, and the "Atlas Ways" brand — are the exclusive property of the Publisher and are protected by applicable intellectual property laws.

Any reproduction, modification, distribution, adaptation, or exploitation of these elements, even partial, without prior written authorization from the Publisher, is strictly prohibited and may constitute infringement.

User content: users retain full rights over the content they create and upload to the application (photos, logbook texts). By uploading content, users grant the Publisher a non-exclusive, non-transferable license, limited solely to the technical purposes necessary for the Service's operation (storage, display, synchronization).

description 12. AMENDMENTS AND GOVERNING LAW

The Publisher reserves the right to amend these Terms of Use at any time. In the event of a material change affecting users' rights, a notification will be sent through the application. The date of the last update is indicated in the document header. Continued use of the Service after notification constitutes acceptance of the amended terms.

Governing Law: these Terms are governed by and interpreted in accordance with the laws of the Province of Quebec (Canada) and applicable federal Canadian laws, without prejudice to the mandatory provisions of European Union law (in particular the GDPR) applicable to users residing in the European Economic Area.

Jurisdiction: any dispute arising from the interpretation or performance of these Terms shall be subject to the exclusive jurisdiction of the competent courts in the judicial district of Quebec, unless a mandatory legal provision applicable to the user in their country of residence provides otherwise.
